Terms of service

§1 General Provisions
1.1 These Terms of Service ("Terms") govern the rules for using the online store available at www.lumatra.pl (the "Store") and for concluding sales contracts between the Seller and Customers.
1.2 The Store is operated by the Seller identified in §2. Reference to "Lumatra" throughout the Store and these Terms is a trading name; the legal seller of record is the entity identified in §2.
1.3 A "Consumer" means a natural person who concludes a contract with the Seller for purposes not directly related to their business or professional activity. Where these Terms grant rights specific to Consumers (e.g., withdrawal rights under §6), those rights are granted to the extent required by the mandatory consumer-protection law of the Consumer's country of habitual residence within the EU.

§3 Placing Orders and Conclusion of the Contract
3.1 Products are presented in the Store together with their price and main characteristics. Product presentations do not constitute a binding offer by the Seller but an invitation for Customers to place an order.
3.2 To place an order, the Customer selects a product, adds it to the cart, provides delivery and contact details, chooses a payment method, and confirms the order ("order with an obligation to pay").
3.3 The sales contract is concluded once the Seller confirms acceptance of the order by e-mail. The confirmation includes the order summary, price, and a copy of, or link to, these Terms.
3.4 Orders may be placed in ENGLISH / POLISH via the Store's interface, 24 hours a day.
§4 Prices and Payment
4.1 All prices displayed in the Store are gross prices, shown in Polish złoty (PLN) and include applicable VAT, unless stated otherwise.
4.2 Delivery costs are shown separately during checkout before the order is confirmed, unless a promotion offering free delivery applies.
4.3 Accepted payment methods are shown at checkout (Visa, MasterCard, przelewy24, blik). Payment is processed by Skrill, which handles the Customer's payment data on the Seller's behalf.
§5 Delivery
5.1 Delivery terms, carriers, costs and estimated timeframes are set out in the Delivery Information page and confirmed again at checkout.
5.2 The Seller is not liable for delays caused by the carrier or by incorrect delivery details provided by the Customer.
§6 Right of Withdrawal (14-Day Cooling-Off Period)
6.1 A Consumer who purchases in the Store has the right to withdraw from the sales contract within 14 calendar days from the day on which the Consumer, or a third party indicated by the Consumer other than the carrier, takes possession of the goods, without giving any reason and without incurring costs other than those described below.
6.2 To exercise the right of withdrawal, the Consumer must inform the Seller of the decision to withdraw by an unequivocal statement (e.g., a letter sent by post or e-mail to the contact details in §2). The Consumer may, but is not obliged to, use the model withdrawal form in Annex 1. It is sufficient to send the withdrawal statement before the 14-day period expires.
6.3 Effects of withdrawal: the Seller will reimburse all payments received from the Consumer, including the standard delivery cost (excluding any extra cost from choosing a delivery method other than the cheapest standard method offered), without undue delay and, in any event, within 14 days from the day the Seller is informed of the decision to withdraw. Reimbursement will be made using the same means of payment used for the original transaction, unless the Consumer expressly agrees otherwise, and will not involve any additional fee.
6.4 The Seller may withhold reimbursement until it has received the goods back, or the Consumer has supplied evidence of having sent them back, whichever is earlier.
6.5 The Consumer must send back the goods, or hand them over, without undue delay and, in any event, no later than 14 days from the day on which the withdrawal is communicated. The deadline is met if the goods are sent back before the 14-day period expires. The Consumer bears the direct cost of returning the goods, unless the Seller has agreed to bear them or failed to inform the Consumer that the Consumer must bear them.
6.6 The Consumer is only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
§6a Exceptions to the Right of Withdrawal
6a.1 The right of withdrawal does not apply to sealed goods which are not suitable for return due to health protection or hygiene reasons if they were unsealed by the Consumer after delivery. This applies, in particular, to items intended for direct contact with the skin or face (e.g., applicator heads, masks with skin-contact padding) that are supplied in hygiene-sealed packaging: once that seal is broken, the item cannot be returned under the withdrawal right, without prejudice to the Consumer's statutory warranty rights under §7 if the product is faulty.
6a.2 Before completing the purchase of any such item, the Store will clearly flag which products, or which components of a bundle, fall under this exception.
§7 Complaints and Legal Guarantee of Conformity ("Rękojmia")
7.1 The Seller is liable to Consumers if the goods are not in conformity with the contract at the time of delivery, in accordance with the Polish Consumer Rights Act and the Civil Code. This liability applies for 2 years from delivery of the goods.
7.2 To file a complaint, the Consumer should contact the Seller using the details in §2 and/or the Contact page, describing the non-conformity and, where possible, attaching proof of purchase.
7.3 The Seller will respond to a complaint within 14 calendar days of receipt. Failure to respond within this period is treated as acceptance of the complaint.
7.4 Depending on the circumstances, the Consumer may request repair, replacement, a price reduction, or withdrawal from the contract, in accordance with the statutory conditions and sequence set out in the Consumer Rights Act.
§8 Personal Data
8.1 Processing of personal data in connection with the Store is described in the Privacy Notice (Document 2 of this package), which forms an integral part of these Terms.
§9 Final Provisions
9.1 These Terms are governed by the laws of the Republic of Poland, without prejudice to any mandatory consumer-protection provisions of the Consumer's country of habitual residence within the EU that cannot be derogated from by agreement, which continue to apply in the Consumer's favour.
9.2 If any provision of these Terms is found invalid, the remaining provisions remain in force.
9.3 The Seller may amend these Terms for valid reasons (e.g., changes in law, changes to Store functionality). Orders placed before the amendment are governed by the Terms in force at the time of the order.
